Packet over CB

Does anyone know the legality of packet over cb in the states?

There is so little information on this, I couldn't find anything.

Data communications in general is allowed in MURS, although repeaters including "store and forward" are not. That could be interpeted to mean that digi-peaters are out. (As if the FCC is really paying attention to stuff on MURS).

Only AM and SSB voice and tone signalling is allowed on 27 MHz. CB in the US.

In the 90s when TDD equipment became more widely available/affordable (there was a time when you could order them for <$200 out of the J.C. Penny's catalogue, of all things) some guys in Vancouver and Orchards set up a CB simplex "packet" net in the upper 20s, I.I.R.C. and as far as I know none of us got any flak from the gestappo about it. Actually there was one who got quickly wiped out, but he was also running a very dirty linear way over-power and was throwing spurious emmissions all over a nearby HAM band and into low-VHF TV. (Would sometimes cause hell with KATU in his vicinity, when it was still on channel 2.) He was back on the air within a matter of days, only he had dialled the power way back.

I recall maybe 20+ Thanksgivings ago when I went back to my parents' house in White Salmon being able to get into the net using an old Ultratec TDD that I got at a flea market, my Realistic CB and a magmount antenna. This is normally a very difficult haul because of the distance and the mountainous topograpy of the region, but the conditions were rather good that week.

Is it "legal"? Technically not as the law is written, but then what is?

Will you get caught? Probably very unlikely.

I'm not saying the thinkpol won't nail you if you try it, but the chances of any of us getting hit by a truck within the next 20 minutes or being elected President in 2016 are a lot higher.
