The Jargon File, a compendium of hacker slang, defines hacker as "A person who enjoys exploring the details of programmable systems and stretching their capabilities, as opposed to most users, who prefer to learn only the minimum necessary."

So I'd guess an "Ethical Hacker" is someone who explores the details of programmable systems and stretches their capabilities for altruistic reasons rather than personal gain.

This is still completely diametrically opposed to the legal system, which is intended to keep the population uneducated and hopeless, making them easier to govern.

I don't see why, script kiddies and other metasploit dependant pen testers aren't hackers, they're just script kiddies plain and simple.
